B. F. Stoltz, as administrator of Henry Stoltz, entered a mortgage with the defendants on 61 acres of land as part of a mortgage, exempting his homestead from the agreement. The defendants alleged that the mortgage was unpaid. They placed a lien on the property, then filed suit to foreclose. Stoltz did not attend the procedure, and his land and homestead were foreclosed upon and sold. Stoltz sued to invalidate the sale and get his homestead back. |

Boyd and Wester were partners doing business under the firm name of Boyd & Wester and are justly indebted to the plaintiffs. In 1866, the plaintiffs obtained a judgment against the defendants for $3,138.57 and defendants levied 560 acres against the debt, conveyed by G. Delozier to Boyd in 1853, but there was an issue of the rightful title holder. |

Particular piece of land in Memphis, triangular in its layout, is the center of this dispute. Grieshaber purchased a large tract of land adjoining the triangular piece and tried to claim it as his own. The city of Memphis argues that the triangular tract of land was donated to the city some thirty years earlier by a Mr. McElmore for the purpose of a park. It seems neither side has an actual deed to the property. The city states it has been considered public property. 2 folders. |

Additional material in ET 786. Plaintiff is the administrator of the estate of T. Martin (dec.). Add. defendants: F. A. James and the heirs at law of T. Martin (listed in full in file). T. Martin owned a tract of land containing 300 acres, on which he resided for 30 years. In 1865, he sold the land to J. Cross for $5,000, for which the defendant executed several notes but never paid in full. Plaintiff sued to determine the rightful title owner of the land against the heirs at law. |

William Brazelton gave deed to tract of land to Samuel N. Fain. A lien was placed on land for payment of $1000 to R. C. Jackson. Plaintiffs charge that deed did not invest William's son James R. Brazelton with title to land. There was a large amount of unpaid taxes due to Jackson. Montgomery claimed mortgage. |

Case started in 1861. According to an 1868 decree, Rombeck's 1/2 interest in a house and lot was sold to Hampt for $568.85. Hampt had issued to Rombeck notes for land. Rombeck sued for unpaid purchase money and the house and lot sold to satisfy debt. |

Ryan & Co. were indebted to Washington for multiple notes totaling $890. Ryan was allegedly hiding out from his debtor. He conveyed his interest in a tract of 150 acres in Robertson County, land he had purchased from James K. Polk. He conveyed growing crops of corn & tobacco to Whitehead. Ryan & those he conveyed property to were sued in order to recover the debt due to Washington. |

Hayes [alt. spelled Haines] bought a tract of land belonging to Griffin at a sheriff's sale for $150. Hayes agreed to become co-surety with Griffin for fines and costs against his son William Griffin in exchange for Griffin releasing his equity of redemption upon said tract of land. Griffin refused to honor agreement and sought to sell land to other parties. Hayes issued an attachment and injunction suit to restrain Griffin from selling land and have Griffin deed/release his rights of redemption. |

The plaintiffs state the defendant mismanaged the will and estate of the deceased in regards to a tract of land that was to remain in the plaintiff's possession for ten years and then be sold for the most beneficial price, but the defendant tried to sell the land before the time stated in the will. |

Stewart & C company under Capt. Thos. C. Buchanan. Forrest told Stewart to recruit men and horses in W. TN by force if needed for the army at Tupelo. Sorrell fled as he found out Lt. Thurmond & a squad of men were coming to take him and his horse. Thurmond took his horse. |

Arminta sued to prevent her house and goods from being sold in the attachment to pay the debts. |

The true conveyance was to read that it went past the line and J. Brooks is refusing to let his boundary go past a certain oak tree on that line because of the mistake in the deed. |
