Connelly, a widow, insured her home an furniture with the plaintiff for $900. In 1896, her home and its contents were destroyed in a fire. The plaintiff filed suit to enjoin the defendant from suing for payment, claiming that she had removed all her belongings from the home prior to the fire and they therefore was not entitled to payment.
