Suit began in 1865. |

Road promised to be built from the north side of bridge to intersect with road to Page's Ferry. Plaintiff alleges profits denied. |

Appellants are arguing that, since Crittenden was the most capable partner and he died before execution of the bond, that the sureties should not be held. |

The plaintiff sought to hold def. to the contract made on her behalf by her husband as her agent. |

She believed that Fulton had created a corporation for the purpose of stripping and selling the commercial property, thereby defrauding Hutchinson. |
