Pla. and def. were granted a divorce in 1926 and entered into a contract setting forth their mutual property rights. Said contract included a guarantee that the def. would carry a $10,000 life insurance policy and name the pla. as his beneficiary. Pla. claims the def. has failed to honor this agreement. |

After Campbell's bills were filed with Sun, the company learned he had not dis- closed his diabetes, nor the death of his sister by tuberculosis.
