Pla. was a passenger on a train owned by agents of the def. when it was going through a tunnel in the mountains and had to stop because of a boulder obstructing the railway. The conductor asked the pla. for assistance to move the boulder. The conductor then pushed the boulder towards the plaintiff without warning, striking him in the hip and back and causing severe injuries and crippling him for life. Plaintiff sued for $5,000 in damages and medical bills. Add. documents located in MT 893. |

Nagle [alt. spelled Nagel] and Hall had made a contract in 1887 in which Nagle rented out his farm to Hall with stipulations regarding timber and crops. Separate contract made in 1888 for different tract of land. Nagle had demanded Hall surrender possession of buildings and premises to him. In a pending case, judgment was given to Nagle for possession of land, which would be done unless this court halted those proceedings. Judge ruled in favor of def't in both cases. |
