Appellants, partners Willis and Crittenden, entered into a building contract with appellees to build a house. Crittenden borrowed $600.00 from his bank on the strength of the building contract. However, Crittenden died before a bond was put in place. Appellants are arguing that, since Crittenden was the most capable partner and he died before execution of the bond, that the sureties should not be held.

View Entry 1926 Bluff City Market Company, Inc. & Bry-Block Mercantile Company v. Mrs. Orie Horne & Jere Horne Shelby Injury and Damages

Bry-Block Mercantile Company operated large dept. store in Memphis. First floor was grocery and meat market. Mrs. Horne slipped on vegetables on the floor, claiming negligence and loss of service for her husband, Jere Horne.

View Entry 1812 David Barton v. William Lytel Rutherford Land and Title Dispute

In 1810 Barton purchased some land in Rutherford County for $500, the title not to be created until the debt was paid in full. However, another man had a right to some of the land and Barton was anxious to have the deed filed. Barton sued so that the entire contract might be cancelled.

Fischer Lime and Cement Company bought land on the north side of Pontotoc Ave. in the fall/winter of 1923-1924. Tony Sorce is sued for damages and injuries resulting from a car accident involving his wife, his minor daughter, and a friend. The Sorces' car accident resulted from going over a retaining wall built by Fischer Lime and Cement Company on their Pontotoc Ave. property. Sorce alleges it was dangerous. Vol. 2 of the civil appeals case regarding the shipment of spokes from defendant to Standard Wheel Co. in Terre Haute. Parkes (also spelled Parks) appears to be the account mgr. for defendant. Affidavits & testimony: C. Flisher, Harry S. Stokes, Isaac Brann, W. P. Murrell, W. L. McFarland & J. W. Pickle. Vol. 1 was not in the same box. Company issued policy 3555 for $1500 to Holland; Holland's mercantile store in Saltillo burned down, with the value of the building being more than $1500, but justly indebted sum of $1500 by contract; Holland transferred and assigned all interest to Bank of Saltillo; Holland charges that Insurance Company is justly indebted to them the full amount of policy with interest; copies of fire insurance policy included;

Josephine Howard is the administratrix for her sister, Maude Howard, an African American girl. Maude fell through a sidewalk grating at the NE corner of Broadway and Louisiana streets in Memphis and passed away ten months after the accident. Before her death, Maude began a suit against the City of Memphis and after her death, Josephine continued the suit.

Mr. Smith and Mr. Crisler, defendants, acquired all certificates, becoming sole real and equitable owners. Complainant suing for a specific performance and/or damages from property contract.

Other petitioners: J.S. Cook, H.B. Dameron, and garnishee L.A. Schwantz. L.A. Schwantz entered into a contract with J.P. James for sale and purchase of real estate in Mississippi. Schwantz was given 10 days to inspect land and sign contract. Joseph Townsend caused garnishment to be issued against Schwentz to pay petitioners per contract. Ezzell arguing that terms of contract never specified time that commission was to be paid and, thus, Schwentz did not warrant garnishment.
