Camp Porter, an African American carpenter, was prosecuted for attempted petty larceny after breaking into the home of John Kent & attempt to rape Kent's wife, Elizabeth Ann Kent. Both Porter & Kent worked for Judge Temple, Porter even lived on his property. Porter would visit the Kent family to visit, while "picking his banjo." Rape charge dropped due to lack of evidence. Plaintiff in error is described as ignorant, uneducated, and having spent time in a penitentiary. Plaintiff in error initially admitted to the burglary but, according to police, was under the influence of alcohol. When he became sober again, plaintiff in error denied the crime. |

Plaintiff charges negligence on railway's part. Perhaps of interest is a passage explaining why poor people picked up coal and wood along the tracks. Other defendants: Alabama Great Southern Railroad Co., Southern Railway Co., and Belt Railway of Chattanooga. Other plaintiffs not named. |
