View Entry 1860 Andrew Susong v. James Allen Greene Trespass with Force of Arms

Susong claimed Allen instructed his black man to throw down Susong's fence (which he did) & Allen went through his field with a wagon, causing damage. Susong had extended a corner of his fence over an old public road that people used in bad weather (when main road was muddy). Witnesses: pla.'s son William A. Susong, Def's nephew Samuel Allen. Lots of testimony about the history of the old road.

View Entry 1868 Aaron Kimbrough v. O. R. Watkins et al. Jefferson Trespass with Force of Arms

Additional defendants: Barnibas Rice, Benjamin Cluck, and George W. Welling. Plaintiff claims he was unlawfully arrested and imprisoned for 8 months by the defendants who were soldiers in the Confederate Army. Plaintiff also claims he was forced to join the Confederate Army. The documents contain the testimony of Samuel A. Bell who commanded the squad that arrested Kimbrough. Bell notes he was operating under the orders of Col. E. D. Blake.

Alexander Haun Jr. sues by next friend Alexander Haun, Sr. for trespass, assault and battery, and false imprisonment against Pleasant A. Witt. sued for damage in the sum of $3,000.

View Entry 1849 Abraham B. Lipton v. Charles P. Shelly Sullivan Trespass with Force of Arms

This is an appeal. Original bill showed Shelly as plaintiff filing suit against Lipton, with William Garrison, James Rhea, Joseph Rhea & Garnet Rhea, for trespass with force & arms plus damages. May 1833, the group restrained Shelly and took 7 horses. In addition, goods & property were taken; the total value of stolen goods equals $1000, the amount Shelly sought for damages.

View Entry 1851 Alexander McMillan v. John Nail Knox Trespass with Force of Arms

Nail accused of entering McMillan's land, erecting a fence, & erecting a dam across Swan Pond Creek causing said creek to overflow & damage the land. Justice of Peace ruled for McMillan & awarded $25 damages, which Nail appealed to Circuit Court. Circuit court ruled in McMillan's favor & awarded $8 damages, which Nail appealed to SC. Nail tried to argue overflowing of McMillan's land caused not by Nail but by mill race conveying water to mill.

Hardins (rebels) accused of beating up Dunns (Union men). Amos & 2 rebel soldiers (James Grant & Bob Sugarts) heard threatening to whip/hang boys in settlement who didn't join rebel army. Testimony notes "the Dunns" were whipped; unclear if that means… ...Plaintiff & his dad or Plaintiff & his son. Amos heard boasting "how the Lincolnite" howled. Both Def.. died during lawsuit & succession of admrs. appointed for each. Events occurred during 1st yr. of war, before the Conscript.
