Brief for the state lays out the facts of the case. Defendant shot prosecutor Charlie Williams 3 times for no reason. Williams fell, but Gibson dry-fired the pistol at him twice more. According to the shooter, Williams had mistreated Gibson's sister. The state admitted that the prosecutor did indeed follow her through a field & woodland, "perhaps for the purpose of soliciting accommodations from her". It stated that "she was or had been a lewd woman, and this was known to the prosecutor." |

Thrower assaulted and attempted to murder Alexander Milliken. Thrower went to Milliken to collect money owed him. Thrower cursed and abused Milliken's wife, Milliken quickly paid him. Thrower came back later asking if Milliken would protect his wife. Milliken got his gun. Thrower left and came back with a gun. Thrower swore to kill Milliken and that he had a spite with him ever since they were in Mexico. |

Edith was a reluctant witness for the state, who claimed Lyons knocked Edith down as she was going up the street & picked her up by her hair. He then hit her in the mouth while they were in the patrol wagon. Edith claimed she fell down & denied he hit her in the mouth. They had been married about a year at the time. |

Edmonson charged with feloniously assaulting Lucile Stephens, a 19 year old, with intent to rape her, and Smith was charged with aiding and abetting Edmonson. According to Stephens' testimony, the defendants were colored. Jury found defendants guilty of intent to rape and robbery and sentenced them to 5 years each for both charges. 2 folders. |

Hines found guilty of assault w/intent to commit 2nd degree murder of M. McGrill, using blunt instrument; sentenced to 5 yrs in penitentiary. McGrill assaulted & robbed in morning at his grocery store at 23rd & Chestnut in Chattanooga. Assault occurred as he stooped down to get dime's worth of tomatoes colored man named Bow-wow had requested, left him unconscious 2-3 wks. Bow-wow identified as Def. Hines. Primarily, case questions whether McGrill properly identified Hines. McGrill also spelled Magrill. |

According to Rawlings, the defendants visited his log home on Christmas night asking for directions and seeking the whereabouts of his son, James Rawlings. Rawlings spoke to them through a window, and when he refused to come outside, the defendants began firing at his home. Plaintiff believes 30 or 40 shots were filled. |

This is an appeal. In original bill, Hays was charged with felonious assault stemming from an attack on Hiram Wing on Dec. 4, 1858. Wing was a conductor on the Western & Atlantic RR of Georgia, & defendant a co-worker. When defendant was reportedly drunk on the job, it was Wing's duty to report this & Hays was fired. The attack was in retaliation. Defendant sentenced to 5 years in TN State Penitentiary. |
