According to Rawlings, the defendants visited his log home on Christmas night asking for directions and seeking the whereabouts of his son, James Rawlings. Rawlings spoke to them through a window, and when he refused to come outside, the defendants began firing at his home. Plaintiff believes 30 or 40 shots were filled. |

According to Vogle, plaintiff and William Fry came to his home late at night and asked for a drink of water. Upon entering the home, Vogel states that Miller began arguing with him and refused to leave, eventually producing a knife. In Vogle's home at the time of the incident were Vogel's wife, his step daughter Lizzie Vogel, and a boarder named Laura Ruble. |
