Plaintiff in error is accused of assaulting Charlie Shelton with a pistol with intent to kill. Shelton was working in a field when the plaintiff allegedly began shooting at him from window in his home. Shelton and the plaintiff were neighbors and had been feuding for some time. Case sought to clarify the ownership of several shade trees. On the morning of the shooting, McDonald's wife Ida was arrested for threatening Shelton with a pistol.
