Joe Black was talking to Holton about a dime that Holton owed him. Woodard approached Holton and asked for a loan. He claims Black winked at Holton. Woodard then assaulted Black with a knife against the peace and dignity of the State. The State charged the defendant with felonious assault with intent to commit murder with a pistol against A. J. Dinwiddy, William McCallum, William Hashbarger, and J. S. White. The defendant had shot at them as they passed through his property. The circuit court found him guilty of assault w/ "intent to commit voluntary manslaughter" and sentenced him to one year in the state penitentiary. |
