The plaintiff charged that John R. Branner fraudulently and without authority placed 100 bonds of $1000 each on deposit with C. Porrell Green & Co., an insolvent banking firm, and for failing to withdraw them upon knowing this as well as for converting bonds for his own and his brother's use. |

Scott was then 13 or 14 years old and according to the bond he would remain as apprentice till he was 21. However without plaintiffs consent Scott joined the U. S. Army they could not regain possession of him. Scott claimed Clements beat him severly with a stick and that he did not receive education or clothes as was stipulated in the bond. |
