Per contract, Smithson threshed wheat crop for Fleming on Mrs. Reaves' farm, to be paid when wheat sold, which it was to grain dealer Y. M. Rizer of Franklin, TN. Plummer Walton, who assisted Smithson in running his thresher, asked to be paid. Smithson (who had been sick for 2 mos) sent him to Fleming, who sent him to Rizer, who paid him. Fleming similarly sent Smithson to Rizer to be paid but, ultimately, Smithson wasn't paid. Hence this suit. Smithson lived in Peytonsville. Wm Jones also involved.
