Nance Motor Co. repossessed Tipton's Plymouth because of delinquent payment. Gump held the note. Unbeknown to Tipton, his son, Will Tipton, bought the car on the same day it was repossessed. Will wrecked the car & Nance picked it up for repair. When Nance attempted to return the car to Will, he would not take it. Nance then went to defendant to induce him to take the car. He would not.
