Addtl dfnt: J. M. Holladay. Bain allowed Holladay, acting as local rep of the Colt Co., to install a carbide light plant in his home a demonstration for the rest of the sales area. This was to be done at no cost to Bain, and would be removed upon his request. Due to misrepresentation, Bain signed a "note" and Colt threatened to sue. Bain has requested the lamp removed, has been ignored and informed he is being charged for the installation and upkeep of said light plant. |

Plaintiff is the owner of a tract of land that he sold to the defendant so they could build a rail road tract on it. In order to build the rail, the defendant had to create a 30 foot high dump about 100 feet wide along his land. Plaintiff appealed to the defendant to create ditches to flow water out of the land or it would ruin his crops and rest of his land, for which the defendant would be charged. Defendants failed to do so and the plaintiff sued for damages to his land in the sum of $500. |
