View Entry 1891 Joseph Ruohs v. The Town of Athens, et al. Knox Breach of Bond

Plaintiff Joseph Ruohs purchased 22 bonds of $1k each issued by the town of Athens, in order to by shares of $22k in stock in the Nashville & Tellico Railroad Company, meant to mature in 20 years. Ruohs accused the defendants, who comprised the Board of the Mayor and Alderman, of failure to pay interest on bonds and therefore, defaulting on said bonds. The plaintiff further accused some defendants of fraudulently avoiding liability by resigning their official posts. See additional case ET 4a about bonds.

View Entry 1891 Mary B. Ely et al. v. W. M. Farrington et al. Shelby Breach of Contract

There is no case file in this folder, only briefs for the appeal. The case concerns a student whose parents withdrew her from an expensive New York school half-way through the school and did not pay for the second term. The school says all families receive a circular stating that students must pay for the full school year, whether or not they are in attendance for the entire year.

View Entry 1891 Nixon & Wester v. Attamont Moses, et al. Hamilton Breach of Contract

Plaintiff Nixon & Wester sued the defendant for repayment of a $172 debt for the contract purchase of 5 car loads of corn that the defendant later refused and was resold at a loss, for which Moses was responsible.

Add. Pla: John D. Moon as President, Daniel Clayton as secretary. Add. Def: W. H. McConnell as President, R. S. Montgomery as Secretary Treasurer, J. W. Nance, William E. Baird, R. W. Pillow, G. H. McMillon admr. of S. B. Marsh dec. and H. M. Bugg. Plaintiffs state they entered into a contract with the defendants to limit their toll collection gates to one gate between their intersecting turnpikes and Lewisburg. Plaintiffs complain there are now two gates. Exhibit material includes map. 2 folders.
