Plaintiffs & defendant had entered a partnership in which Arrow Transfer would take over distribution of Atlas Beer & plaintiffs would withdraw after being paid $2000 by deft. Deft. paid first $1000, but not the additional monies, saying plaintiffs had no franchise rights to sell although Atlas Beer had approved the agreement. |

Defendant cancelled contract in order to use another ad agency. Plaintiff filed suit seeking $2,570.81 for breach of contract. Plaintiff engaged the defendant to investigate his property lines & insure his title. Also took out $1500 policy with company to insure against failure of title. After assurances that everything was in order plaintiff began work on his building, only to be sued by L. W. Lynch, who claimed that the building extended 18 inches onto his property. Plaintiff lost the suit & was unable to complete his building. He sued defendant to collect the $1500 plus penalties provided by law. |
