Illinois railroad tie company sued Dunaway alleging they breached 1906 contract to sell timber rights on Cora's Henry City tract of 1200 acres on the Tennessee River & on the Kentucky state line. In 1913, TN passed legislation emancipating married women. So Cora then filed suit on her own against tie company & her husband, Robert H. Dunaway. Dispute over type of timber to be taken off the land (only red & white oak, which was suitable for railroad ties) & status of account between the parties. |

Price of corn, $1.40 per bushel. The defendants shipped 2455 bushels of the corn and there still remained 2545 bushels to be delivered. After defendants were given more time to deliver corn, they refused to deliver the rest. |

Plaintiff owned a flour mill in Jefferson County near Holston River. McFarland entered into a contract with the defendant in January 1855 in which he sold Cawood 100 barrels of flour to be delivered to Chattanooga at the price of $6.50 per barrel. McFarland claimed the flour was never delivered and therefore a breach of the contract. Other defendant not named but R. M. Hooke and J. J. Bryant mentioned in the case file. |

Add. Defendants: Fletcher Brown & Frank Thomas. The parties entered into a written agreement for the timber located on a farm owned by one Robert Chad well's heirs to haul the timber away. This was carried on for some time by the defendant, but S. Brown took over, but failed to take the logs off the property after cutting them, failing to uphold the contract. Later, the defendants under careless management, stacked the logs in a negligent manner, injuring the integrity of the lumber. |

The work was not completed by the deadline stated in the contract, the materials were subpar, and the construction was unskilled. Finley was a pawn broker and had lost an expensive diamond from his store. Dugger told Finley he had found it at jewelry store in Chattanooga. Finley paid Dugger to retrieve the diamond for him. Dugger spent that money, plus more on credit from Finley. Finley sued to get the money back, but Dugger was insolvent. |

On December 23,1913 complainant went to inspect cotton seed to be shipped and found that it was below quality he had contracted for. Defendant told complainant he had sold the cotton seed to other parties and would not be shipping any seed to complainant. Also included are 2 booklets: 1) Petition for Certiorari and Assignment of Errors, Brief in support. 2) Defendants answer to petition of certiorari. |

Complainant failed to deliver lumber on date agreed upon by himself and Aiken, but argued that a second contract was agreed upon by both parties, which modified the first contract's penalties.
