Anderson purchased a house and lot on Axie Ave. in Memphis from Langford. At the time of the purchase, the property was mortgaged to the Goodman Bros. for about $500. Anderson and Langford set up a contract for him to pay her $50 a month until a total unpurchased price of $1500 was paid. Langford would pay the mortgage to the Goodman Bros. until it was paid off. After Anderson had already moved in and paid Langford $257.25, Langford tried to up the selling price to $2500. |

Lawson would bring down the trees, producing the boards, & the lumber company old sell them. Lawson sued Lizzie Yett Cox over a note for $500. The settlement of this suit became entangled in the payments & debts of Lawson & U.S. Andes' dealings. |

In the original bill, Haynie alleged that he purchased seven lots in the A. A. Mellier subdivision along with additional adjoining land. Haynie sold everything but one lot. The bill was filed to "recover for an alleged deficiency of 55 feet and 2 inches." He sued for breach of contract and damages. Case deals with land trading for corporate stock. John L Eichberg is a mechanic and dealer of tin. He was hired and signed a contract with L.C. Castle to put a tin roof on a cottage owned by W.J. Jefferson. Castle was acting as the contractor for the remodeling of said cottage. Jefferson and Castle had a disagreement and Castle was fired as contractor of the job and Jefferson took over. Eichberg completed the word on time and claims he has yet to be paid the $322.50 that he is owed for the job. |

Plaintiff Joseph Ruohs purchased 22 bonds of $1k each issued by the town of Athens, in order to by shares of $22k in stock in the Nashville & Tellico Railroad Company, meant to mature in 20 years. Ruohs accused the defendants, who comprised the Board of the Mayor and Alderman, of failure to pay interest on bonds and therefore, defaulting on said bonds. The plaintiff further accused some defendants of fraudulently avoiding liability by resigning their official posts. See additional case ET 4a about bonds. |

Plaintiff, which is based in CA, sued defendant for breach of contract. On 31 July 1908 defendant contracted with plaintiff to buy 500 sacks of large Blackeye Beans which were shipped on 6 Oct. 1908. Without cause defendant refused to accept beans. After the refusal the price of beans declined, forcing plaintiff to sell the shipment to a broker at a $392.83 loss. Defendant argues beans were not accepted because they were full of dirt. |

Complainant sued defendant over a breach of warrant due to purchase of defective automobile (Overland) and many costly repairs to said automobile. Complainant alleges false representation made by the defendant, sues asking for damages and bank notes on sale canceled. Court decision ruled in favor of plaintiff, damages of $150.00 plus costs. Decision appealed to the Court of Civil Appeals at Jackson. Newspaper included as evidence, alleging the automobile had been in a prior accident. |

Fizer offered Jackson partnership in a livery company. At the time of the stock trade, Jackson, who had a tidy inheritance, was allegedly so drunk as to be incapacitated. Some stated that he was mentally unbalanced at the time of the deal. It was suspected that in making the trade, Fizer took advantage of Jackson's state and cheated him. When deft. found himself unable to pay the debt & faced a forced sale of the land he entered into a contract whereby the plntff. would pay the debt in full in exchange for the retention of all of the rights held by the current creditor. Plntff. paid the debt but sued because deft. refused to repay him. |

In August, 1916, Campbell entered into a verbal contract with Madison Cotton Oil Company whereby they would employ him for one year as general manager beginning on 8/12/1916. In September, Campbell was informed by letter to resign his position as general manager. Campbell replied that he refused to voluntarily resign. Madison Cotton Oil Company formally discharged him around the 20th of September - owing him around $400.00 which was not paid to Campbell. |

Plaintiff is the owner of a tract of land that he sold to the defendant so they could build a rail road tract on it. In order to build the rail, the defendant had to create a 30 foot high dump about 100 feet wide along his land. Plaintiff appealed to the defendant to create ditches to flow water out of the land or it would ruin his crops and rest of his land, for which the defendant would be charged. Defendants failed to do so and the plaintiff sued for damages to his land in the sum of $500. |

In 1914, the parties entered into a contract to saw and stack all the timber from a certain tract of land and the plaintiffs would install a saw mill on their property for cutting. The defendants failed to pay the plaintiffs for their work and the cost of the mill fell upon the plaintiffs. They are suing for the sum of $1,120 as specified in the contract. |

Deft. argues that the contract was always for 1 year only, & that the said document shows signs of alteration to make it appear to be a 3-year contract rather than a 1-year contract. 5 Folders |

He has since learned the deft. mortgaged the premises to Hamilton Trust & Savings Bank to secure a $1000 indebtedness. Plntff. is now suing for breach of contract to recover monies already paid & monies spent on improvements that he made to the property. |

John A. Davis and Co was comprised of John A. Davis and James B. Hughes. Plaintiffs entered into a contract with the defendant to purchase a large lot of mules, wagons, and carts for $7,775. The defendant also cosigned to the plaintiff enough coal to keep the purchased teams occupied. Plaintiff now complains that the defendant did not ship enough coal causing them to lose money each month. Plaintiff is suing to collect the lost revenue. 2 folders. |
