Plntff. asks court to cancel deft's policy, release it from any liability, & enjoin the deft. from making a countersuit in any court. Plntff. maintains the deft. Intentionally made false statements when filling out his application & this is part of a a plan to defraud as deft. holds policies with several companies & has filed disability claims with them although his disability existed before he took out the policies.
