View Entry 1894 Fannie Friedman, et al. v. Aetna Insurance Co. Rutherford Insurance Claims and Policies

Additional plaintiff: J. Friedman (also spelled Freedman). Plaintiffs suing for the use of D. W. Butler. Plaintiff owned a small clothing store located on the south side of the public square in Murfreesboro, Tennessee. Her store and stock of goods were destroyed by fire on February 2, 1894. Plaintiff brought suit complaining that the defendant, an insurance company, refused to honor her policy. Casefile notes that F. Friedman did not speak English fluently. Her nationality is unclear.

Add. Plaintiffs: R. M. Barry & James G. Bare. Add. Defendant: Virginia Bond & Mortgage Company. Plaintiff is acting as Trustee for J. G. Bare. Plaintiffs bought a property that had certain debts held against it held by Virginia Bond for approximately $4,000.00. The building was later destroyed by a fire and the defendant refused to pay out on the policy held by it because of the debt. Plaintiffs suing for the face amount of the policy for $1,500 along with a 25% penalty.

View Entry 1877 Fannie C. Williams by next of friend Thomas Shakleford v. Eleanor N. Carson et al. Davidson Insurance Claims and Policies

Additional defendants: H. C. Carson (husband of def.), William Nichol, and G. W. Civrey. Plaintiff was a minor. H. O. Williams, father of plaintiff, died in 1871. He left a life insurance policy to his executors, administrators, and assignees. However, when he died he was indebted. The defendant was his widow who had since remarried. As widow and admr. of Williams she was trying to collect the policy. She claimed Williams made a non cupative will excluding Fannie, his daughter from his first marriage.

Plaintiff seeks to have Gussie Taylor declared deceased due to her being missing for 7 years, and to then collect on deceased's life insurance policy. Plaintiff is the widow of Augustus P. Bryan and the mother of Billie Bryan and Betty Jo Bryan, minors. In 1935, the deceased took out a policy with the defendant for $5,000 and died in 1936 under the full force of the policy. The defendants refused to pay the full benefits of the policy, inflicting additional expenses and injury upon the plaintiff. Exhibits include 4 photographs of exterior and interior views of a family living on a shanty boat that has been moved onto land.

View Entry 1898 Home Insurance Company v. Mrs. M. J. Connelly Davidson Insurance Claims and Policies

Connelly, a widow, insured her home an furniture with the plaintiff for $900. In 1896, her home and its contents were destroyed in a fire. The plaintiff filed suit to enjoin the defendant from suing for payment, claiming that she had removed all her belongings from the home prior to the fire and they therefore was not entitled to payment. The plaintiff further requested that the policy be cancelled. Exhibit is insurance document.

Wurzburg sued, claiming that the proceeds from a life insurance policy on the life of Seymour Wurzburg should be paid to the estate and not to Specialty Manufacturing. View Entry 1919 Hugh Gardner v. Farmers Mutual Insurance Co. Carroll Insurance Claims and Policies

Hugh Gardner took out a regular 5 year policy in the sum of $500 with the Farmers Mutual Insurance Co. of Carroll County. The policy was to insure his house and all its contents. On 11/18/1917 he received a notice that he owed $2.00 as an assessment. This was the only notice he received. On 11/19/1917 he lost his house and all its contents in a fire. When he tried to collect on the claim the Insurance Company refused to pay. Court sided with defendant. Gardner appealed.

Plaintiff was a firm composed of A. Hemphill and William Warner. Plaintiff entered into a contract with the defendant for protection against fire damage. The contract was accidently written to make the insurance payable to Hemphill alone. In 1892 a fire destroyed plaintiff's building and the property within. Plaintiff brought suit seeking to reform the contract in order to make it payable to the partnership. Casefile includes contract documents. 2 folders.

Plaintiffs claimed they had purchased insurance to cover their hay, but after a fire occurred that destroyed their hay insurance would not pay for the loss. Amount of loss was $800. Hay was stored in a barn owned by the plaintiffs on a farm known as the McKinney Farm, located on the Jefferson Davis Highway just outside of Ripley, TN. Bassett & Clapp were partners in a lumber business in Memphis; took out life insurance policies worth $6000 & each assigned his policy to the other; premiums paid out of partnership funds. Business dissolved 1 Jan. 1893 by mutual consent. Plaintiff now suing for half of the $6000 premium to which defendant maintains he is not entitled.

Plaintiff received life insurance policy from John Hancock via his employer, American Glanzstoff. Policy provided for payout if policy holder became disabled before age 60. Plaintiff claimed total disability, but defendants refused to pay. American Glanzstoff was subsidiary of the Austrian company Vereinigte Glanzstoff-Fabriken AG. The company produced synthetic silk (rayon). "Glanzstoff" can be roughly translated as "shiny/shimmery stuff."

Jolley's insured building was allegedly completely destroyed by fire. Upon investigation by his insurance company, the Milwaukee Mechanics Insurance Co., the damage was found not to be a total loss. Jolley sued to prove that the building was damaged beyond use and to recoup the difference.
