Collier claims that, during his term as Montgomery County sheriff, he was deprived of control of the county jail & workhouse (and revenue derived therefrom), and that such deprivation resulted from the county's actions under a state law passed in 1883. This state law provided for the appointment of commissioners to oversee the county jail & workhouse. Collier argued this law was unconstitutional. |

Governor William G. Brownlow introduced and pass the Act of 1868, Chapter 65. Under the new law D.W. Tucker was appointed Tax Collector. He was charged with negligently collecting taxes, failing to collect $1661 the County was owed. |
