Kennedy sued Allen & Phillips for breach of contract, seeking damages for a roof installed on a brick block house in Dayton, Tn. Kennedy purportedly contracted Allen & Phillips to install a steel roof warranted for three years. The roof leaked, because the roof slope was insufficient. Kennedy was allegedly told these facts & asked for the roof to be installed anyway. |

Because the city engineer did not personally measure the work, an arbitrator did fieldwork to determine the volume. |
