View Entry | 1876 | T. A. Criswell v. Thomas Leek | Wilson | Contract Dispute and Damages |
Criswell sold 180 cords of wood @$3.50 per cord to Leek in March 1864. Leek paid for 90 cords and had his son delivered those cords to him. The remaining wood was left on the bank of the Cumberland River from where it washed away. Leek withheld payment for the washed-away cords of wood. Criswell sought payment from Leek who claimed Criswell breached the sales contract for nondelivery of the remaining wood. Leek claimed further the risk of loss in a sales contract remained on the breaching party. |
