Kennedy purportedly contracted Allen & Phillips to install a steel roof warranted for three years. The roof leaked, because the roof slope was insufficient. Kennedy was allegedly told these facts & asked for the roof to be installed anyway. |

The plaintiff made a contract with the defendant in 1888 to cultivate his land and he was to furnish the land and a mare. Each party was to bear half of the labor and the plaintiff was to feed the mare used to work the fields. After two months and before the work was done, the defendant took back the mare, halting any yield from the crops. The defendant was damaged $50 for feed provided and a breach of contract. |
