Price filed a petition for a writ of habeas corpus alleging his minor daughter, Annie Laurie Price, to be unlawfully detained by the defendant, her maternal grandmother. Price had married Nona Lowder, daughter of the defendant by former marriage, but she later died of tubercular trouble. The defendant was given temporary custody till the plaintiff could care for the infant. Defendant admitted she had custody of the infant but it was not unlawful.
