Defendant is a company comprised of T. P. Green, M. Shafner, & William Cooper. In 1885, the parties entered into a contract for the plaintiff to sell and deliver to the defendants two million feet of yellow poplar logs free from defects. Def. advanced him $1,275. After the logs were measured, a majority were washed away in a tide on the river and the defendants fraudulently changed the wording of the contract without plaintiff's knowledge to make him liable for the lost logs and monetary advance. |
