Bowman had borrowed money from Carr, but Carr died before he could collect the debt. Ethan Hurst administered Carr's estate and attempted to collect for it. Bowman entered evidence in the form of a receipt--signed by Carr--stating that the debt had been paid. Receipt, a scrap of paper, was attested by [illegible] M. However, plaintiff states that the defendant now refuses to leave and is a hindrance to the running of her home. Carr charged that Love had taken from Burns an option on the lands & had intentionally misled Burns regarding the option's terms. Defts. sold the land for $40 an acre, realizing $1540.00, but accounted to Burns for only $577.50 which was $15 per acre minus a 5% commission. |

As security for debt, Ferrell assigned to VanBebber claims he had against others, including lawsuit against Thomas McClain for breach of warranty deed. McClain died while suit pending.
