Plaintiffs wanted the court to give a judgment that they were not liable to pay the costs of a previous case in which they were require to be bound for costs. Chadwick was the deputy Sheriff who was to execute the collection of costs.

Def. obtained judgment against pla., but did so with no notice to pla., which led pla. to file this suit, alleging the judgment was illegal & that, had he received notice of the suit that led to the judgment, he had large claims against Def. that would have offset the amount of said judgment. Original judgment was before justice of the peace.

pla. owed Def $300-$400, for which Def held notes. pla. visited Def at Def's store in Tazewell & in part discharge of said debt, pd $90 to Wm Neal, then doing business for Def in his store, Def being on journey to Eastern cities to buy goods. pla. then discovered mistake & notified Neal, who notified Def, but Def failed to correct it, leading to this lawsuit. Chancery Court district then included Grainger & Claiborne Counties.

Sawyer claimed that the hotel company owed her $400.00. Defendant executed to G. W. Montgomery (also a defendant) a general assignment of all its property of every character and description. A detailed itemization of the hotel contents is included. Sawyer claimed fraud, but ultimately, her suit was successful; she received all hotel property contents. [34 pages from old Box ET 1625 were added to this total on 7/24/17.]
