Plaintiff rented land to Ellis McGuire, a black man, who gave a $225 note on Jan. 1873 promising to pay off the note when the 1873 cotton harvest was sold. On the way to the market, Dec. 23, 1873, the 4 bales of harvested cotton were attached by def who who had obtained a judgment against McGuire for the unpaid balance of $71.72 owed on the purchase of a horse during the spring of 1873. Plaintiff relieved the bales claiming delivery of the bales by McGuire. So, McGuire owned no bales for attachment. |

Defendant in error brought suit seeking payment of a debt due from the sale of railroad ties. The plaintiff in error charges that many of the ties in question were of inferior quality. Some controversy also surrounds the practice of merchants leaving ties at the railroad yard for the railroad co. to pick up and use. Case file notes this practice often resulted in payments being delayed until after the railroad used the ties, up to a month later. |
