Smith & Huff were endorsers of note drawn by James W. Rodgers, payable to Huff at Def's bank, with understanding Smith & Huff were accommodation endorsers only. Note matured, Rodgers failed to pay, & bank didn't pursue payment from Rodgers (then solvent). When Bank finally sued in Circuit, Rodgers insolvent, so Smith & Huff filed this suit in Chancery asking to be absolved from liability as endorsers. Add. Def: James G.M. Ramsey (Bank president).

Additional defendants: George's wife Mariah, John Doss & wife Mary, & Catherine Allison. In 1841, a Uriah Allison was indebted to plaintiff for ~$1875 in exchange for several tracts of land. As security, Allison gave plaintiff 2 women & 2 children slaves The slaves as security were worth ~$900. Upon Uriah Allison's death, his debt hadn't been paid. Plaintiff sought to sell slaves and land necessary to recover the $1875.

Bell cited to court on warrant issued against Bell & Smith in favor of John Russell. Bell knew nothing of the debt, which seemed to be predicated on note signed "Bell & Smith" in handwriting of B.S. Smith, Bell's former partner. Though Bell thought the debt to be unjust, he paid half of it (to avoid litigation), with the rest to be paid by Smith. But Smith got his brother-in-law Cox to delay execution & when the delay was over, Smith was broke. Cox paid the balance & then sued Bell.
