Plaintiff is the beneficiary of Thomas (Tommie) Large (dec.) who held a policy with the defendant for life insurance. The defendant is indebted to the plaintiff in the sum of $465 plus a 25% penalty for failure to pay and damages. The defendant claims that a warrant of death as never issued to them by the plaintiff and therefore they are not liable to pay the policy.

Add. plaintiffs: Frank Hill (dec.), Robert Hill, & Mrs. J. W. Gorman. Original bill was a suit upon contract when the plaintiff was threatened with civil action by his half brothers and the county Undertaker upon an alleged liability for his father, F. Hill's, burial expenses. He absorbed unnecessary expenses and inconveniences. He was later judged against for the sum of $260. Includes motion for a rehearing, new trial, and petition for certiorari.

Additional defendants: Lillian M. Harris, E. C. & Hazel Graves, Virgie French, all citizens of 11th Civil District of Sullivan county, The First and Peoples National Bank of Gate City, Virginia, The Equitable Life Assurance Society of the United States. Dispute over tract of land owned by the defendant wanted by the petitioner to use in connection with the erection of a school building. Petitioner has asked that the defendant to furnish this land for school purposes but defendants have refused.

The original bill was filed by E. C. Huff to collect payment on an insurance policy with the principle sum of $5,000. E. C. Huff won judgment on the original bill, and this bill was filed by the insurance company to rehear the case.

View Entry 1938 W. H. H. Southern v. Charles F. Whiteside Knox Debt Dispute

Clarence Lovelace, member of Knoxville Bar, had office next door to Sothern's office on Market St in Knoxville, 2nd floor. Lovelace kicked out & sheriff was going to put his bookcases & books in the street, so Southern asked officer to instead place same in Sothern's office until Lovelace could make other arrangements. American Law Book Co later sued Lovelace & attached the bookcases & books, which were then sold to Whiteside. Dispute arose when Whiteside failed to pick up same or pay for storage.
