Plaintiff is sues defendants to recover a 500 acre tract of land in the newly formed Houston Co (portion formerly in Stewart Co.) Plaintiff claims tract under a grant from the State of TN to Thomas D. Mackbee for 5000 acres dated 1838. Defendant claims land under TN grant to G.W. Bell and Henry Lockhart for 5000 acres in 1857. Both parties admit both grants cover the land in question. Bells heirs include: Benjamin Bell, Joseph Bell, Johnson Bell, Franklin Bell and Luella Bell.

View Entry 1888 Owen B. Withers et al. v. E. T. Bogard Stewart Land and Title Dispute

Additional plaintiffs: Gramille S. Withers and wife Mary E. Withers. The Withers assert their rights to a property owned by their ancestor Joshua Cates; proving their title using Cates' will and agreement with his son-in-law Hiram B. Withers from 1838. The land in question had been sold by Hiram B. Withers in 1852 and subsequently sold to other people to the then current owner, Bogard in 1875.
