Additional defendant: C. M. Black. The case involved a dispute on a tract of land owned by the plaintiff. Perry was a new citizen of Franklin County and befriended the defendant. Black offered to assist Perry with the land in question and Perry executed his notes for $2700 to Black in order to keep it away from his enemies. Once the property was safe Black was to rescind the contract. However Black bought the rest of the property and kicked Perry of the land. |

The Robertson's as heirs at law of H. F. Robertson, dec. owned land in Lincoln County. Robertson died intestate in 1857. Hardy Smith was found to be owed money from the estate in the sum of $2384. Robertson had no more money, so Smith sued the heirs for the land to satisfy the debt. |

In 1870, a decree was executed to the plaintiffs granting title to a tract of 200 acres. Woodard had filed suit in 1879 to cancel said deed, which was dismissed. See: F. R. Woodard v. James C. Grant, et al. found in box MT 643. Woodard still refused to give up land to plaintiffs. Plaintiffs suing for possession of land and for rents due to them since 1872. 2 folders. |

Addtl dfnt: Mrs. N. E. Days. Pltf. was born in enslavement to Parmelia and Peter Embrey, at the time Parmelia was still enslaved, but Peter was a freeman. As a freeman, Peter accumulated a small amount of property before his death. His will and codicil attempted to give all property to his wife and daughter. For some reason, pltf. wants them declared void. Parmelia remarried with Henry Banks. Banks granted a fraudulent deed to Lewis Days to settle debts. Acklen wished to reclaim the property rights. |

Rufus Speck is the next friend of Philman, Sam, Glen, George, Fannie, and Hartie Speck, minor heirs of Amos Speck. Add. Def: John Easterwood, and Ann Speck, widow of Amos Speck. Before his death, Amos Speck purchased land from Easterwood, a portion of his debt for said land remains unpaid. Ann Speck later negotiated with Easterwood to relinquish the title to the land in exchange for receiving a part of the land back. Pla. argue that their mother had not right to negotiate said transfer. |

Nagle [alt. spelled Nagel] and Hall had made a contract in 1887 in which Nagle rented out his farm to Hall with stipulations regarding timber and crops. Separate contract made in 1888 for different tract of land. Nagle had demanded Hall surrender possession of buildings and premises to him. In a pending case, judgment was given to Nagle for possession of land, which would be done unless this court halted those proceedings. Judge ruled in favor of def't in both cases. |

Hannah purchase a tract of land as part of a sale decreed by the court. Following the Civil War he could not pay the notes and his son John G. Hannah purchased the land for $400, receiving a deed in 1867. After the death of W. L. Hannah, his heirs filed this bill to enjoin the sale of the land to have the mortgage of John G. Hannah removed as a cloud on their rightful title. |
