Plaintiff is the widow of Roland Harkins. Her father Michael Hickman (dec.) gave her a tract of land in Sullivan County. Her brother Peter (dec.) suggested a trade of their two adjoining lands and a conveyance was made and the trade took place before his death. It was sold to the defendant to pay off debts of Hickman's estate. Since no new deeds were made for the trade of land, the defendant, who lived on the one property for 7 years, then attempted to eject Harkins from the one tract to the other. |

Wallis Estill died in 1835 leaving a will. Wallis Estill, Jr. was executor. The fathers' will gave a enslaved woman named Milly to his illegitimate granddaughter, Eliza Ann. Wallis Estill, Jr. died without having fulfilled the trust left by his father. Peter S. Decherd was executor of Wallis Estill, Jr. estate. Dechard found that Estill had hidden the directives of the fathers' will as regarding the slave Milly who was to go to Eliza Ann who had married John Lowe. |
