The def was a benefit fund insurance company & had issued Whiteside's husband a fund of $2k payable to her upon his death. Her husband died with all premiums & dues up to date. They refused to pay stating that Charles Whiteside was in poor health when he signed the paperwork. Whiteside sued to recover the benefit due her from claim. |

Court ruled in favor of Strong and McIntyre, because Kinzel based his land sale details on an 1871 deed. His deed did not mention land that had been parceled off and sold separately. Since Kinzel had not paid taxes on the land for 26 years, it was encumbered with debt to the county. |
