Sometime later, when the property was examined it was found to be "not what it was represented to be." |

Robert's mother, Mattie Mann, was Taylor's second wife. Taylor claims that he wanted Robert to share in his estate equally with his six children. When he purchased a tract of land, the deed was made in such a way that it listed Robert as one of the owners of the land. He only discovered the error when he tried to sell the land. |

Rochester loaned her daughter and son-in-law the money for the purpose of redeeming said diamonds from pledge. Deceased gave petitioner the diamonds as collateral security. Miller then gave her a note for $2800, but after her daughter died Miller fraudulently took possession of the diamonds. Exhibits include a cashier check for $2800. |

Schwantz was given 10 days to inspect land and sign contract. Joseph Townsend caused garnishment to be issued against Schwentz to pay petitioners per contract. Ezzell arguing that terms of contract never specified time that commission was to be paid and, thus, Schwentz did not warrant garnishment. |
