H.B. Dameron sold land through his real estate agent, R.A. Ezzell. The contract for the exchange of real estate stated "that the witness would have ten days within which to inspect the property, but that on account of severe storms, he was unable to make said inspection." "He accepted the contract in full without inspection, and a notation of this acceptance was signed by him on the contract." Sometime later, when the property was examined it was found to be "not what it was represented to be." |

Clair Rochester Miller, deceased. The deceased and her estate are indebted to petitioner in the sum of $2800. Rochester loaned her daughter and son-in-law the money for the purpose of redeeming said diamonds from pledge. Deceased gave petitioner the diamonds as collateral security. Miller then gave her a note for $2800, but after her daughter died Miller fraudulently took possession of the diamonds. Exhibits include a cashier check for $2800. |

Other petitioners: J.S. Cook, H.B. Dameron, and garnishee L.A. Schwantz. L.A. Schwantz entered into a contract with J.P. James for sale and purchase of real estate in Mississippi. Schwantz was given 10 days to inspect land and sign contract. Joseph Townsend caused garnishment to be issued against Schwentz to pay petitioners per contract. Ezzell arguing that terms of contract never specified time that commission was to be paid and, thus, Schwentz did not warrant garnishment. |
