Mattie sued her husband for divorce. They married in Tennessee in 1874 where they lived for 6 years. In 1880, they moved to Texas. Plaintiff was sent home to her father's. Defendant promised to return to her but never did. Plaintiff suing defendant for willfully and maliciously abandoning her for 8 years and for failing to provide for her. Judge believed it was her fault that he remained away. Court dismissed her case and had her pay cost of suit. Plaintiff appealed. |

Pltf. stated he had proof and had heard dfnt. was unfaithful to her vows and engaged in sex ual intercourse with J. F. Snyder multiple times. Pltf. asserted his faithfulness, but acknowledge that her age (33) and his (60) may be a factor, as he is "not a very vigorous man."
