Marks was indicted in criminal court in Giles County for multiple causes. An election as held at the county precinct 11 to elect the sheriff and constable, justice of the peace and Peace School director. Marks was accused of "misrepresenting the name on the ticket" or ballot, in order to fraudulently change the ballot. |

Stuart, Marshall (incumbent) & Hugh A. Lane ran for county sheriff; Marshall narrowly won. Lane contested the election on grounds of fraud; Stuart was not involved in Lane's suit against Marshall. Later, Lane & Marshall admitted to election fraud, so Stuart brought a suit averring that the public interest had been aggrieved. Voting irregularities included persons being able to vote 2x-3x for Marshall, and Lane votes being counted as Marshall votes. 900+ illegal votes alleged. |
