Hatcher said interest was past due; Owen said he'd forgotten, offered it to pay it then; Hatcher refused, said he was going to resign as guardian & ward's mom was thinking about qualifying. Hatcher remained guardian, but pla. (judgment creditor of Owen) sued to reach Owen's equitable interest. |

Plaintiffs seek stay of execution, charging that they had paid balance. |

Cost of suit was paid in full and $1256.06 of decree was paid-the remainder was offset by several judgments in favor of Frobaugh against Jones. Frobaugh supposed debt satisfied. Frobaugh now wants stay of execution because Supreme Court did not deduct amount due Frobaugh from Jones from the amount decreed to him against Jones. |
