H.Y Britton Jr. and his brother, A. H. Britton entered into a written contract with J. H. Parnell to buy a certain property in the City of Memphis- 2241 Madison Ave., for $6750.00. Britton inspected the property shortly afterward and took Parnell upon his word regarding the property lines. He later found out that Parnell had misrepresented the property lines and had perpetrated a fraud. The suit was originally brought in the Chancery Court asking for a rescission and cancellation of the deed and mortgage. |
