Phillip Phillips owned land, died intestate, leaving the property to his heirs. A faulty survey was made & submitted to the County. Some of the land was accidentally sold by the sheriff. The land was incorrectly taxed as well. Suit was filed to clarify land boundary's, ownership, and taxation value. Armstreat Stubblefield owned 640 acres of land on Norris Creek off the Elk River that he was supposedly authorized to sell. He contracted to sell a portion to Oliver Hayes, of whom paid almost the full amount due. However, once the amount was paid in full Stubblefield neglected to discharge the debt. Additional defendants: Gideon Pillow, John Ingram; John Bright, surveyor.

View Entry 1912 Walter Hines v. State Lincoln Land and Title Dispute

Opinion only. 60 years before, William Crawford had set aside 1 acre of his farm as a family cemetery where he was buried. His descendants also used it as a burial ground and were buried there too. The question in the opinion was whether the prosecutor and other descendants of Crawford had a right of easement of burial in the cemetery and for purposes of visiting and repairing the graves. Judge believed they had these rights and did not injure the owner of the farm.
