Land dispute of properties previously owned by Benjamin Collins of Hancock Co. containing fifty acres, lying on Newman's Ridge, same county. Children of Benjamin Collins: Marler Collins, Wyatt Collins, Ezekiel Collins, Andrew Collins, Jordan Collins, Nancy Collins, Betsy Collins, wife of Martin Collins; Polly Collins, wife of Willis Gisson (sic); Edmond Collins, Milenton Collins, and Benjamin Collins. Court-ordered partition of land among heirs and defendant. Appealed.

View Entry 1855 Edward T. Bale v. Elizabeth King & William A. Rowan et al Hawkins Land and Title Dispute

Add. defs: Charles King, Lucinda Rowan, Jacob Varnal a Freeman of Colour. Bale (m. Mahala Bussel, daughter of Wm Bussel, dec) accused defs of going into Bale's wheat field & cutting, binding, carrying off, & converting wheat to their own use. Defs say wheat not on Bale's land, but land owned by Elizabeth, wife of Charles (now dec) & daughter of Wm Rowan who lived at mouth of Beech Creek & drowned in Holston River, & her claim is through her dad, who purchased from Michael Montgomery who had NC grant.

View Entry 1855 Fanny Wallin v. Daniel Huff Claiborne Land and Title Dispute

Fanny's husband James (dec) & John Wallen claimed title to 1 of 2 tracts of land (which they had divided between them), & James Lake was a tenant in possession on John's portion. View Entry 1855 Martha E. Stephens, guardian, et al. v. W. W. Porter, et al. Monroe Land and Title Dispute

Jacob Baker died intestate, his land then partitioned by the heirs, & H. Stephens, Martha's husband, appointed agent to sell the land. It was sold to Mr. Cleburne, who then sold to W. Porter. This suit sought to ify these sales of the land, & return it to the heirs. Martha was placed in an asylum, making her husband the heir to the land. However, the paperwork filed with the court initially left out Martha's incompetency, & therefore were faulty in naming the appropriate heirs.

View Entry 1855 Moses C. Winston v. George W. Stubbs et al Roane Land and Title Dispute

Winston owned 65 acres on Big Poplar Creek & Big Indian Creek, to which both Winston & defs claimed title. Add. defs: Charles M. McGhee, Barclay McGhee, J.W.J. Niles & wife Margaret W. Niles (added selves as defs claiming title to land in dispute). Jury ruled in favor of defendants.

View Entry 1855 R. T. Bridges & wife Caroline Bridges v. Absalom Guinn Meigs Land and Title Dispute

Bridges owned 80 acres of land in Hiwassee District & claimed Guinn ejected them from it. As the court put it, Bridges had a "younger grant [to the land] founded upon the elder entry" & Guinn had the reverse, "the elder grant but the younger entry." The Bridges' claim was through Caroline's dad Dennis C. Murphy. Guinn's claim was through a man named Reynolds said to be the first settler of the land, & Guinn was in possession of the land when Murphy died.

View Entry 1855 Samuel C. Cowan v. The Heirs of Nicholas Smith by their Guardian, Thomas Smith, & Thomas N. Frazier Marion Land and Title Dispute

Cowan sued Nicholas Smith for ejecting him from land to which he held title. During suit, Nicholas died & suit revived against his 3 minor children (Hugh, Amanda, Clarissa) for whom their grandfather Thomas Smith served as guardian. After initial mistrial 2nd jury ruled in favor of Def.. Dispute was over competing claims of title to 100 acres of land "up and down the Branch." Frazier was security for Nicholas Smith.

Add. Defs: Martha Ann Ford, Joseph Shelby Ford & William D. E. Ford, minors, sued by their next friend Eliza J. S. Ford. Dispute over 2 adjoining tracts of land (one 100-acre & one 160-acre) on Flat Creek. Court ruled for Pla. re 100-acre tract & for Def. re 160-acre tract. Two exhibits (included in page count): both are plat maps related to the property in dispute.

View Entry 1855 Wesley Casey v. James D. McFall Rhea Land and Title Dispute

Casey sued McFall for cutting timber from Casey's land & converting it to McFall's use, and also for rent McFall owed Casey. Dispute revolves around boundary line between Casey's land & McFall's adjoining land. Others involved: Solomon Wyrick, William Wyrick & Martin Wyrick, who at one point were in possession of some portion of disputed land, & who (with McFall) were defendants in previous lawsuit brought by Casey.
