Add def: Elma Wells, John Wells, Albert Wells, and Wallis Wells. Rebecca Wells was the widow of J. H. Wells dec. Pla. recovered a judgment against J. H. Wells and a levy was executed against his property including a storehouse and lot. Pla. purchased interest in said property at sheriff's sale. After the death of J. H. Wells pla. filed a bill alleging that they were tenants in common with the defendants by virtue of their purchase of said property and brought suit seeking its partition or sale. |

In 1861 Neil wrote a promissory note for $1500 to Wiley and his sister Jane Wiley for land he purchased from them. Neil married Jane Wiley, who died shortly after without a leaving a will. The sheriff sold the land to satisfy debts, and Gragg was the purchaser. The land, deed, and debts were transferred a number of times and this suit was filed to legally settle lawful ownership. |

Blackwell) as a mortgage or deed for the repayment of his debt to Rob't Williams After debt was repaid, tract would revert to the possession of A. J. Arena passed (and divided her estate between her siblings), and Thos. Completed the debt repayment, but refused to remit land. Pltfs. sued to assert ownership of tract. |

Pltf. married J. E. Gilbert in 1867, and divorced in Texas in 1892. During their marriage J. E. Gilbert swapped a deed with dfnt. for tract of land in TN. However, pltf. owned the deed through homestead and did not agree to or sign the transaction. She asserted the swap made and void, as her former husband did not have the appropriate ownership of the deed to make such an exchange. |

In 1859 Thompson sold E.K. & Mary Rambo land in Marshall County and issued a title. Although he conveyed the deed, he held a lien against the property until the payment for the property was complete. Payment was not completed and Thompson sued to recover the balance on the account. |

Under a decree from a previous case Bank of Lewisburg v. Moorman & Co., R. L. Adams was forced to sell a tract of land known as the Edwards tract. Fowler was the highest bidder. After securing notes on the land, the seller requested more money. Fowler sues to get his money back so he can invest elsewhere. |

Smiley, a colored man, bought 46 acre property from Cannon, who later sued to enforce lien & had land sold, but Smiley redeemed land by paying the debt, borrowing money from Williams to do so. Subsequent shenanigans resulted in Williams claiming he owned the land outright & trying to dispossess Smiley. Court said no. Others mentioned: Dysort. Land bounded by property of W.J. McAdams, S.H. O'Neal is admr. of the estate of Julia F. Williams. Addtl dfnt: John Smiley (alas Jack Smiley). The Smiley's are noted as colored in the file, but not in the title. Richard Smiley conveyed by deed to Robert Williams a tract of land. Robert died, leaving leaving the tract to his wife, Julia F., who also passed. O'Neal sued as admr. of the Williams estate. |

M.D. Driver died leaving widow Loniza & 7 children including John F., exe of M.D.'s estate. 54+ acres of estate land set aside for dower & other land sold to pay estate debts. John became indebted to Spurlock & widow sold land to satisfy debt, but stayed in possession w/o paying rent so Spurlock sued in Circuit Court to attach land for rent (see case in MT Box 721) . Rent still not pd, so Spurlock brought this suit against widow & children to settle dispute & appoint receiver & guardian for minor children |

Additional defendants: M.H. Card and wife Mattie Card. Gates had sold a house and lot to Card and his wife for $325-$100 to be paid in cash and the rest in two promissory notes of $150 and $75. Notes went unpaid as defendants were insolvent. Gates agreed to refund their cash money and cancel their notes if defendants would give him a quit claim deed. T.S. Montgomery refused to give up deed unless Gates paid Card's debt to his brother R.S. Montgomery, which Gates said he was not liable. |

The plaintiffs dispute their mothers right to distribute their inheritance. Defendants claim E.M. Record signed a deed of trust C. McCord, their testator, for $1505.41, and on the same day, Mrs. Record sold the same property to her daughter Medora. Defendants claim fraud, as E.M. defaulted on deed of trust. |

Joseph Duncan died, leaving numerous slaves, personality & 300 acres of land (which, by purchase, widow Winnie increased to 532 acres). Joseph's sons William & Atlas mortgaged land to Tally, leading to dispute over Tally's alleged possession of the land & destruction of timber thereon. Defendants except Fox and Nix are the widow, children, and heirs of the late James M. Ledbetter. There was a sell of lands belonging to the late Josiah Brecheen, plaintiff's father. Brecheen purchased lot No. 2, executed a mortgage with Fox for the balance due. Fox was to pay the clerk which he failed to do. |

Pla. filed this suit to recover from Def.. rents & profits (from crops & timber) that Def. wrongfully received from said land & to sell the land at a partition sale. (In amended bill, several Add. Pla. & Def. added.) |
