Plaintiff alleged that he is the heir of A.G. Maxwell, dec. A G.G. Maxwell who was appointed admr for deceased pretended to file petition against heirs of deceased in order to sell a tract of land. The land was sold to defendant. Plaintiff alleged that sale was invalid because G.G. Maxwell was not the admr of deceased and therefore had no right to sell land.
