3 folders. Plaintiff purchased from defendant a tract of land in Memphis for which a deed was executed. Defendant conveyed to defendant that he held a perfect title to the land and the defendant paid $9,000 for the land. In reality, part of the land was owned by the Southern Railway Company. Exhibit materials include a photograph of building scaffolding, several maps of lots on different streets, and a hand written Abstract of Title to the land. |

Both Sherry and his co-defendant, Dennis Saxton, were from Shelby County. John McKinley died leaving two lots of land in Memphis. The plaintiffs include Andrew McKinley of New York, Luther T. Thurston of Kentucky, Mary Churchill of Louisville and her daughter Mary Moss Churchill, Julia January and her husband Derick A. January of St. Louis, and Robert M. Patton of Alabama. Plaintiffs allege that the lots were never sold to the defendants and that they obtained possession of them illegally. |

Particular piece of land in Memphis, triangular in its layout, is the center of this dispute. Grieshaber purchased a large tract of land adjoining the triangular piece and tried to claim it as his own. The city of Memphis argues that the triangular tract of land was donated to the city some thirty years earlier by a Mr. McElmore for the purpose of a park. It seems neither side has an actual deed to the property. The city states it has been considered public property. 2 folders. |
