Add def: Next friend T. C. Dillon, Jack Greece, Margaret Greece, Bessell May Marshall. The land originally belonged to Henry Marshall, dec. 1892 intestate. His son Tom Marshall, was married to Augusta, Bessell was his child. Henry was indebted to J. D. Knies, who foreclosed on the land sold it to Milton. The plaintiffs, ancestors of Henry, here disputed the sale.

This is not a complete case file. The cause of action in the case appears to be related to the question of who is the rightful owner of a tract of land.

Additional Defendants: Penelope Gillespie. Dec. 1875, def. J.S. Gillespie made note payable to complainant for $818.58 due 12 months after date with interest at 10%. In Dec. 1876, J.S. Complainant charges Gillespie conveyed deed without enough to pay his liabilities. Compl. Charges that Penelope Gillespie had no separate estate.

Plaintiff sold a lot near city of Memphis to Perkins for $4750, $500 to be paid in cash and balance secured by notes of Perkins & deed of trust on property. Defendant refuses to accept deed, charging a defect in the title.

Sues for the purchase amount of the land. Additional defendants include the heirs of A. C. Crook.

Both parties were heirs of William Boyer, dec. D. P. Boyer purchased the interest of other heirs except for the plaintiff in a tract of land they inherited. J. A. Boyer petitioned to have the land partitioned so he could claim his 1/11th interest or have the land sold to collect the same.

The plaintiff and defendant contested the re-conveyance of a deed to a house and lot in Cowan, Tennessee. The defendant, who is partners with the plaintiff, asserted that he had no knowledge of the option to reconvey when he signed the deed.

Case involved dispute over land owned by Leonard in which he allowed part of land to be used by others as a right of way but after he became upset with Leroy he moved his fence to block right of way. See Also: ET, Box 1716 for rest of case.

Sallie Hawkins was the wife of Kindrick Hawkins. D. M. Coile was the deputy sheriff of Jefferson County at the time of the case. Additional case names: W. C. Bayless and Florence N. Bayless.

An act passed by the State Assembly in 1858 warranted the transfer of the property of the Female Branch of the Rhea Academy to the Greeneville Masonic Lodge No. 119. However, the deed was never given to Nugent, and he and his brothers sued in order to get proper title to the property and its furniture.

O'Neal is admr. of the estate of Julia F. Williams. Addtl dfnt: John Smiley (alas Jack Smiley). The Smiley's are noted as colored in the file, but not in the title. Richard Smiley conveyed by deed to Robert Williams a tract of land. Robert died, leaving leaving the tract to his wife, Julia F., who also passed. O'Neal sued as admr. of the Williams estate.

The original bill states that Pla. Fowler and Annie R. Comer claimed to be the heirs of land in Jackson County that was once owned by Lucinda M. Fowler and V. M. Fowler via the will of James G. Cunningham. Despite the land being sold by their father when they were minors, they claimed they are entitled and sued the current owners of the land--the defendants. Additional defendants: Miranda Overton, W. J. Reavis. Plaintiff claimed defendant defrauded him of his property while he was in a mental institution after being shot and wounded by one of the "Gailey boys" and he was incapable of making sound judgments.

Incomplete case file: brief for plaintiffs only. Threat sued Beaty to clarify the boundaries between their lands. For years trees had been used to mark boundaries of the properties, but logging & general disagreements called the boundaries into question.
