Additional Plaintiffs: C. B. Johnson, B. F. Cockrell, and W. E. Morison. Additional Defendants: J. J. Gibson, T. F. Gibson, and E. H. Patterson. Plaintiffs bought an option to purchase a tract of land of 800 acres at $8 per acre. They entered into an agreement for half ownership of the land with the defendants for half of the option purchase price. Defendant Slusher took deed in trust from the seller but then refused to accept the plaintiffs money and give them title to half the land.

File incomplete. Opinion only. Opinion for a West TN case filed among East TN cases. The heirs-at-law of Sallie W. Lewis sued the heirs-at-law of Bronson(?) Bayliss to recover the title to a 45-acre tract of land in the Memphis suburbs on the grounds that the deeds under which Bayless held the property were actually intended as mortgages.

View Entry 1891 H. H. Rodgers v. W. T. Todd Cannon Land and Title Dispute

Plaintiff claims he is the rightful owner of a tract of land located in the 4th Civil District of Cannon County near Stone's River and has been for seven years. Plaintiff further claims that while in possession of said land he built a house and mill, cultivated the land, and harvested timber. Plaintiff complains the defendant is now claiming ownership of part of the property and is seeking an injunction restricting him from taking possession. Exhibit material includes map on page 30.

Add. defendants: Taylor and Sally Lewis, and V. R. Harris. Plaintiff complains that a tract of land purchased from J. F. Outlaw and lying in Houston County was unlawfully executed against by a Justice of the Peace for debt due to McFall and John F. Nolan by Outlaw. Nolan does not appear to be named in the suite. Plaintiff further complains that said land was seized and sold at auction to McFall. Plaintiff is seeking for defendant's title to be declared void.

View Entry 1891 J. I. D. Hinds v. J. A. Kellogg, et al. & J. A. Kellogg v. Mrs. E. J. Lewis, et al. Davidson Land and Title Dispute

Additional defendant in "Hinds v. Kellogg:" T. H. Cousens. Additional defendants in "Kellogg v. Lewis," unknown. Hinds is the owner of a home situated on Church Street in Nashville and described as being a part of lot no. 120 in the Hayes addition. Hinds complains that Kellogg and his tenant Cousens occupy his property and refuse to surrender it to him. Kellogg claims said property was never actually sold to Hinds. Lewis was a previous bidder on said property and assigned her bid to Hinds.

Additional Defendants: Sallie Charles, John Cape, and Charles Harris. The plaintiff sued the defendants to reclaim 42.5 acres of land he claimed to have a grant for from the state through Governor Robert L. Taylor. He charged the defendants with illegally possessing said land and striping it of its valuable timber. Claymon requested an injunction to halt the removal of resources from the land and requested a survey of the land and confirmation of its ownership. Includes hand-drawn map of disputed land.

This case is a land dispute. Plaintiff originally owned land with her first husband, when he died she remarried William Younger who sold the land, without her knowledge, to W.W. High. Plaintiff disputed the validity of the sale. Additional Defendants: W.W. High, dec., J.M. Church, N.R. Wilkes. Additional Plaintiffs: R.P. Dodson. Case in 2 folders. Margaret Shields, wife of John, sued Riverside Improvement Company in order to set a deed aside made years previously. However, because Shields was a woman, and the original deed executed while she was a minor, the legitimacy of the original deed was questioned.

View Entry 1891 Mary W. Parks, et al. v. Henry Edmundson, et al. Davidson Land and Title Dispute

George Wilson gave 67 acres in Davidson County this daughter Matlida George Edmondson, wife of Jon K. The land was further divided, & 20 acres were given to Jon, which he gave to W. J. Parks, who mortgaged the land as security on another debt. Matilda & Jon died, & the Parks property was foreclosed upon. This suit sought to settle the ownership of the land following its division, & the death of its owners.

View Entry 1891 M. L. Blackley and Wife v. John Brown and Wife Sullivan Land and Title Dispute

The Blackleys filed suit to recover $2000 from the defendants for an advance they provided the defendants to discharge liens on a farm known as Marble Hall in Hawkins County. The Blackleys exchanged their real estate in Bristol for Marble Hall, estimated at a value of $7700. The defendants alleged that the title to some of the property failed and a building was not completed according to contract. The defendants also filed a cross bill (counter suit).

View Entry 1891 Ollie Petree v. Henry Berry et al. Union Land and Title Dispute

Additional Defendants: Joseph Ellison & Ben Berry Jr. Plaintiff Ollie Petree, widow of Joel Petree, deceased, claimed rights to land her husband bought, and occupied, from George W. Petree and his wife. However, the deed was never registered. In 1883, without the plaintiff's consent, George Petree and his wife signed over the deed and registered the land to Henry Berry who then sold it to Joseph Ellison. Ellison then conveyed partial ownership to Ben Berry Jr.

Other plaintiffs: Jeptha M. Foulkes, Dave H. Hayden & wife, Annie S. (formerly Foulkes), Alfred T. Hayden & wife, Maggie C. (formerly Foulkes), and Edna Hatcher. Other defendants: W. S. Vance and the Tennessee Sand Co. Plaintiffs say defendants took possession of property owned by complainants; defendants say the title had been conveyed to them. Folder contains several briefs.

View Entry 1891 Thomas Feaster and Emma Feaster v. E. F. Mynatt, et al. Knox Land and Title Dispute

Other defendants: M. F. Caldwell; Barney Irwin. Feasters hired Mynatt & Caldwell (attorneys) for $250 to defend Frank Holly, who was charged with murder in Williamsburgh, Ky. Feasters paid $57 in cash & thought they signed a mortgage on their lot on Franz St. in Knoxville to Mynatt & Caldwell for the remaining $193. Feasters were illiterate & what they signed was a warranty deed for the full $250. Mynatt & Caldwell then proceeded to sell the lot to Irwin.

This bill was filed to determine ownership of a plot of land. Plaintiffs alleged that land is theirs as it was purchased together with their deceased step-father. However, defendant and their step-father's widow claimed that she was the rightful owner. Additional Plaintiffs: J.N. Sublett, D.L. Sublett. Additional Defendants: Emily Duncan, Edna Duncan, Andrew Childress, Jack Robertson.

Add. Pla: Mary McPherson, Charles, Frank, and Carrie McGan, B. L. James, E. J. James, and E. M. and Margaret Rogers. Add. Def. unknown. Def. McIver represents the heirs of Col. W. B. A. Ramsey. Ramsey was the owner of a large amount of real estate in East Nashville. Plaintiffs are heirs of G. C. McGann, who purchased a lot from Ramsey. Pla. believe they are the rightful owners of said lot. Def.s believe McGann failed to pay the notes on said land and therefore title reverted back to Ramsey's heirs.

Add Def: Jos. Wisdom. This suit is to remove a cloud upon the title of the plaintiff caused by a tax sale, and to recover possession of land. A crossbill, "C. K. Boswell et al. v. West Point Iron Co.," filed by Boswell and others, claimed the land by virtue of a title bond. Exhibit materials include a plat map. 2 folders.
